Terms of Service

By using nocteer.com or buying from LumiScrubs, you agree to these terms. LumiScrubs is operated by {{LEGAL_ENTITY}}, a {{LEGAL_STATE}} company.

Effective date: May 17, 2026.

1. Acceptance

By placing an order, creating an account, or using this site, you accept these Terms, our Privacy Policy, our Shipping & Returns policy, our 365-Day Quality Guarantee, and our Cookies Policy. If you do not accept any of these, do not use the site.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under the law of your jurisdiction. Team-order accounts require you to have authority to bind your organization.

3. Orders, pricing, and availability

• Prices are in USD and exclude tax and shipping unless stated otherwise.
• We reserve the right to correct pricing or specification errors. If a price changes between order and shipment, we contact you before charging.
• Stock levels reflect our best estimate; in rare cases items may sell out between order and fulfillment, in which case we refund in full within 5 business days.
• Custom, embroidered, named, and team-packed items become final-sale once production begins. We confirm artwork before that point.
• We may decline or cancel any order at our discretion (e.g. suspected fraud, shipping address restrictions).

4. Shipping and delivery

See Shipping & Returns. Summary: blank US orders ship in 10–18 business days, embroidered orders 17–25 business days, via SF Express International tracked transit. Free US shipping over $59. We are not responsible for delays caused by customs, address errors you provide, or carrier-level disruption beyond our control.

5. Returns and exchanges

Blank unworn items: 30 days from delivery, full refund. First size exchange shipping is on us in both directions. Embroidered, personalized, and named items: final-sale once stitching begins. See Shipping & Returns for the full policy.

6. 365-Day Quality Guarantee

We cover construction defects (seam splits, severe pilling, major fade, hardware failure) for 365 days from delivery. Send a photo, we send a replacement within 2–5 business days. See 365-Day Quality Guarantee for what is covered vs ordinary wear.

7. Account responsibilities

If you create an account, you are responsible for keeping your password confidential and for any activity under your account. Tell us within 48 hours if you suspect unauthorized access.

8. Acceptable use

You may not use the site for any unlawful purpose, to harm minors, to transmit malware or spam, to scrape data beyond what robots.txt permits, to attempt to gain unauthorized access to systems or accounts, or to interfere with normal operation. We reserve the right to suspend access for any violation.

9. Intellectual property

All content on this site (text, images, code, designs, brand name, the "LumiScrubs" mark) is owned by {{LEGAL_ENTITY}} or licensed to us, and protected by copyright and trademark law. You may not copy, redistribute, or create derivative works without written permission, except for normal browser caching and personal non-commercial use. The "LumiScrubs" name and any associated logos are trademarks of {{LEGAL_ENTITY}}.

10. Customer-provided artwork

If you provide artwork for embroidery, you warrant that you own or have license to use it, and you grant LumiScrubs a limited license to reproduce it on the items you order. You indemnify us against third-party intellectual-property claims arising from artwork you supply.

11. Reviews and submitted content

If you post a review, you grant LumiScrubs a non-exclusive right to display, edit for length, and quote the review on our site and in marketing for as long as we maintain it. We do not seed or fabricate reviews. We may remove reviews that are off-topic, abusive, or violate any law. See our Reviews policy.

12. Disclaimer of warranties

Beyond the 365-Day Quality Guarantee stated in section 6, the site and products are provided "as is" without further warranties, express or implied, including merchantability or fitness for a particular purpose. Fabric claims are limited to the verified blend, four-way stretch, and water-repellent finish described on the product page; no regulator-grade or barrier-grade representations are made.

13. Limitation of liability

To the maximum extent permitted by law, LumiScrubs and {{LEGAL_ENTITY}} are not liable for indirect, incidental, consequential, or punitive damages, or for any lost profits or business, arising from your use of the site or the products. Our maximum aggregate liability for any claim is the amount you paid for the products at issue.

14. Indemnification

You agree to indemnify and hold harmless LumiScrubs, {{LEGAL_ENTITY}}, and our officers from any claim arising from your breach of these Terms, your customer-provided artwork, or your violation of any law.

15. Governing law and disputes

These Terms are governed by the laws of {{GOVERNING_LAW_STATE}}, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in {{COURT_VENUE}}, and you consent to that venue. Nothing in this section restricts a small-claims action in your local court for amounts within that court’s jurisdictional limit.

16. Changes to these terms

We may update these Terms from time to time. Material changes will be posted here with an updated effective date. If you have an active subscription or open team order, we will email you about material changes.

17. Severability

If any provision of these Terms is held unenforceable, the remainder remains in effect.
